CNSNews.com – 08/0910 – U.S. District Judge Vaughn R. Walker, who ruled last week that a voter-approved amendment to California’s constitution that limited marriage to the union of one man and one woman violated the Fourteenth Amendment of the U.S. Constitution, based that ruling in part on his finding that a child does not need and has no right to a mother.

Nor, he found, does a child have a need or a right to a father.

“Children do not need to be raised by a male parent and a female parent to be well-adjusted, and having both a male and a female parent does not increase the likelihood that a child will be well-adjusted,” the judge wrote in finding of fact No. 71 in his opinion.

“The gender of a child’s parent is not a factor in a child’s adjustment,” the judge stated in finding of fact No. 70. “The sexual orientation of an individual does not determine whether that individual can be a good parent. Children raised by gay or lesbian parents are as likely as children raised by heterosexual parents to be healthy, successful and well-adjusted. The research supporting this conclusion is accepted beyond serious debate in the field of developmental psychology.” Read Full Story Here

Charlie Butts – OneNewsNow – 8/5/2010 A California federal judge has overturned Proposition 8, the legislation that declares marriage between one man and one woman is the only form legally recognized in the state.

Brad Dacus, founder of the Pacific Justice Institute, concludes that the decision is outrageous.

“This is a classic case of judicial activism. Proposition 8 has already withstood a legal battle and challenge pursuant to the California constitution. There is absolutely nothing in the U.S. Constitution that guarantees homosexuals some kind of right to the institution of marriage,” the pro-family leader contends. Read Full Story

Judicial Watch 08/04/10 – Last week, the American Enterprise Institute held an event on the national security issues we still face almost nine years after the September 11, 2001 terrorist attacks.  Former Speaker of the House Newt Gingrich addressed the audience in an hour long speech focusing on radical Islam and the government’s responses to national security threats.

According to Gingrich, the United States is failing to address national threats in numerous areas.  These include our declining economy, which puts us at risk of being overshadowed as a leading economic power by China and India, and the rise of “secular socialism” in modern politics.  This results in a system that purposely overlooks growing threats and “defends reactionary institutions that are incompetent in order to prop them up.”  We certainly saw this issue with the multiple bailouts of institutions that were supposed to be “too big to fail.” Read Full Story Here

Judicial Watch Update - The U.S. Secret Service recently denied Judicial Watch’s request under federal law for visitor logs for the Office of Vice President Joe Biden. In April, Judicial Watch filed a Freedom of Information Act (FOIA) request for records of visits made to the Vice President’s Washington D.C. Office/Residence and of visits to his residence in Wilmington, Delaware. The Secret Service responded that the requested records are not accessible under FOIA. Earlier this year, Judicial Watch filed a FOIA lawsuit against the Secret Service, after it denied access to the White House visitor logs

Judicial Watch specifically asked the Secret Service for access to:

1.) All official visitor logs and/or other records concerning visits made to the Vice President’s Residence and Office located on the grounds of the United States Naval Observatory from January 20, 2009 to the present.

2.) All official visitor logs and/or other records concerning visits made to Vice President Joe Biden’s residence in Wilmington, Delaware from January 20, 2009 to the present. Read Full File Here

Lisa Leff – Associated Press Writer – 8/4/2010 -  SAN FRANCISCO  - A federal judge overturned California’s same-sex marriage ban Wednesday in a landmark case that could eventually land before the U.S. Supreme Court to decide if gays have a constitutional right to marry in America.

Chief U.S. District Judge Vaughn Walker made his ruling in a lawsuit filed by two gay couples who claimed the voter-approved ban violated their civil rights.

Supporters argued the ban was necessary to safeguard the traditional understanding of marriage and to encourage responsible childbearing.

California voters passed the ban as Proposition 8 in November 2008, five months after the state Supreme Court legalized gay marriage.

“Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples,” the judge wrote in a 136-page ruling that laid out in precise detail why the ban does not pass constitutional muster.
